1. Acceptance of Terms

By accessing or using the website nsxhvac.com (the “Site”) or engaging NSX Heating & Air Conditioning (“NSX,” “we,” “us,” or “our”) for services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use our Site or services.

2. Our Services

NSX provides residential and light-commercial HVAC services across Chicagoland and Northwest Indiana, including:

• Air conditioning repair, installation, and maintenance
• Heating, furnace, boiler, and heat pump repair and installation
• Ductwork design, sealing, and installation
• Indoor air quality systems
• Plumbing and electrical services (as available)
• Preventive maintenance plans
• 24/7 emergency service

All services are subject to availability, service area, and technician scheduling.

3. Eligibility

You must be at least 18 years old and the property owner or authorized decision-maker for the property to request and authorize service.

4. Communication & Account

When you request service or contact us through the Site, you agree that we may contact you via the phone number and email address you provide. You are responsible for the accuracy of the information you submit.

5. SMS Program Terms

Program description

NSX operates a mixed transactional and marketing SMS program to keep customers informed about appointments and to occasionally share promotions and seasonal reminders.

Message types

• Transactional (appointment-based): Confirmations, technician ETA, service updates, quotes, invoices, and follow-ups.
• Marketing (opt-in required): Seasonal tune-up reminders, maintenance-plan promotions, and business updates.

Message frequency

Message frequency varies. Marketing recipients typically receive fewer than 8 messages per month, in addition to any transactional messages tied to specific service appointments.

Message and data rates

Message and data rates may apply based on your mobile carrier's plan. NSX is not responsible for any charges from your carrier.

Opt-out (STOP)

You may cancel your SMS subscription at any time by texting STOP to any message you receive from us. After you send STOP, we will send you a confirmation message and will no longer send SMS messages to you. To rejoin, sign up again through our website form or reply START.

Supported carriers

All major U.S. carriers are supported, including AT&T, Verizon, T-Mobile, Sprint, Boost, U.S. Cellular, and MetroPCS. Carriers are not liable for delayed or undelivered messages.

Privacy

Mobile information collected as part of the SMS program (including your phone number and opt-in status) will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for full details.

6. Pricing & Payment

• Estimates are provided free of charge for most residential jobs; complex commercial estimates may require a site visit and a fee that is applied to the job if accepted.
• Diagnostic service fees are quoted upfront and applied to the repair cost if you proceed with the recommended work.
• Payment is due upon completion of service unless prior financing arrangements are made through our partner (Wisetack).
• We accept major credit cards, ACH transfers, cash, and financing.
• Past-due invoices may incur a late fee of 1.5% per month or the maximum permitted by Illinois law, whichever is lower.

7. Service Warranty

NSX warrants that all workmanship will be performed in a professional manner. Specific warranty terms depend on the type of service:

• Repairs: 30-day workmanship warranty on the specific repair performed.
• New equipment installation: Manufacturer warranty (typically 5–10 years on parts) plus 1-year NSX workmanship warranty.
• Maintenance visits: No warranty on future failures beyond items serviced during the visit.

Warranties do not cover damage from misuse, neglect, unauthorized modification, acts of nature, or normal wear and tear. Written warranty details are provided with your invoice.

8. Limitation of Liability

To the maximum extent permitted by law, NSX's total liability arising out of or related to your use of the Site or our services is limited to the amount you paid to NSX for the specific service giving rise to the claim. In no event will NSX be liable for indirect, incidental, special, or consequential damages, including lost profits, loss of data, or business interruption.

9. Indemnification

You agree to indemnify and hold NSX harmless from any claim, damage, or expense arising from your breach of these Terms, your violation of any law, or your infringement of another party's rights.

10. Intellectual Property

All content on this Site — including text, images, logos, and graphics — is the property of NSX Heating & Air Conditioning or its licensors and is protected by copyright and trademark law. You may not copy, reproduce, or use our content for commercial purposes without written permission.

11. Third-Party Links

Our Site may contain links to third-party websites (for example, our booking partner or financing partner). NSX is not responsible for the content, privacy practices, or terms of those sites.

12. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Cook County, Illinois.

13. Changes to Terms

NSX may update these Terms at any time. The updated version will be posted here with a new “Last Updated” date. Continued use of the Site or our services after changes constitutes acceptance of the new terms.
